I- The lawyer's fees: transparency requiring objective pricing criteria

The Lawyer's fees are set freely in agreement with the client.

However, the firm does not set the fees at random, which are determined according to objective criteria:

The nature of the Advocate's mission (consultation, assistance, representation, advice, drafting of legal acts - assignments, conclusions, requests - drafting of a private deed - transactions - pleadings)
The time of the lawyer's mission (number of days of hearing - several weeks in criminal trials - judicial delays in certain civil proceedings, unwillingness of the client to ask for regular referrals ...)
The matter in which the Advocate is called upon to carry out his duties (criminal law, medical law, labor law, family law, aliens law, property law ...)
There are different methods of charging fees, which must be set out in order to provide transparency to the fees charged by my law firm.

It is already necessary to indicate to you that I systematically solicit from the courts the reimbursement by the adverse party of the legal fees and expenses that you have paid in defense of your rights.

Indeed, it would be unfair to leave the court costs and lawyers' fees at your expense, even if you have succeeded.

Finally, it should be noted that duty-free fees must be added to the value added tax of 19.6%, which is borne by the customer.

II- Different methods of invoicing the fees charged by the firm CAVROIS

A - Fee agreement: a contract between the lawyer and his client

The fee agreement is a written contract between the lawyer and his client, setting out in advance the method of calculating the fees (hourly rate or lump sum), for the due diligence performed and the results obtained.

This agreement remains optional, but allows a certain transparency of the billing.

B - Time billing: a transparent billing mode

The lawyer can also agree with his client to decide on billing in the past. This is probably the most reliable and transparent billing method.

The law firm appends to the billing a table of work schedules and the diligences accomplished in your procedure (appointment to the office, telephone interviews, transfer to jail, study of the procedure, drafting legal acts, transaction And correspondence, hearings)

It is therefore important to agree with the Advocate on the hourly rate of the fee, which varies according to the nature of the case (criminal law - correctional or criminal law, labor, family law, medical law, etc.); Of the client's income.

C - Consulting and advisory fees

The appointments in my office aiming at obtaining legal advice not requiring the opening of a file, is invoiced at the end of maintenance between 150 € and 250 € HT, depending on the time spent , Solicited information and advice.

However, this interview does not involve an immediate payment of fees, in the event that your file is entrusted to the firm. Indeed, the package set up includes the appointments to the firm of Avocats.

D - Fixed rate billing

The Advocate and his client may also agree on a global fee in a particular proceeding.

In some cases, such as uneducated cases with a single hearing, mutual consent divorce proceedings, simple dismissal procedures, it is possible to practice a pre-determined fee which includes all due diligence 'Advocate, until a court decision is rendered, that a transaction is executed, or, more generally, that the file is closed and archived.

Obviously, the lump sum is determined according to the importance of the procedure carried out. A simple matter of driving without a driving license does not represent the same cost as a drug trafficking case.

E - Payment of fees by monthly installments

Payment facilities may be granted for clients who do not have sufficient financial means but can not access legal aid.

The fees can then be paid in several monthly installments.

F - Legal aid

The Cabinet agrees to fulfill its mission to provide access to Justice for All. Consequently, legal aid in the field of criminal law is possible.

G - Additional charges not included in fees

The fees are not included in the fees paid and remain the responsibility of the

 

  • Air or rail freight,
  • Accommodation costs (hotel),
  • Costs of private or judicial appraisals,
  • Translation costs for acts,
  • Expenses of lawyers,
  • Costs of bailiffs (service of documents),
  • Costs and fees of lawyers at the Court of Cassation or the Conseil d'Etat (appeal in cassation).
